Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SecureBuildIQ website, applications, and services (the "Service"), provided by SecureBuildIQ LLC ("SecureBuildIQ," "we," "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SecureBuildIQ is an operations and project-management platform for security and low-voltage construction teams, including AI-assisted device takeoff, live floorplans, field check-off, equipment tracking, dashboards, and reporting. We may add, change, or remove features over time.

2. Accounts & eligibility

You must be at least 18 and able to form a binding contract. You are responsible for your account, your login credentials, and all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.

3. AI features & no professional advice

The Service includes AI-assisted features that generate estimates, summaries, device lists, risk scores, and other outputs. These outputs may be inaccurate or incomplete and are provided as decision-support only. They are not engineering, security, legal, financial, or other professional advice. You are responsible for independently verifying device counts, installations, commissioning readiness, and any other output before relying on it. Do not use the Service as the sole basis for safety- or security-critical decisions.

4. Subscriptions, billing & refunds

Paid plans are billed per seat on a recurring (e.g., monthly) basis through our payment processor, Stripe.
Subscriptions auto-renew until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.
Except where required by law, fees are non-refundable and partial periods are not prorated.
We may change pricing; changes apply to future billing periods and we will provide reasonable notice.
You are responsible for any applicable taxes.

5. Your data & ownership

As between you and us, you own the data and content you submit ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for having the rights to the Customer Data you upload and for complying with laws that apply to it. Our handling of personal data is described in our Privacy Policy.

6. Acceptable use

You agree not to: (a) break the law or infringe others' rights; (b) upload malware or attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; (c) resell or provide the Service to third parties except as permitted; (d) misuse AI features to generate unlawful, harmful, or deceptive content; or (e) exceed reasonable usage in a way that degrades the Service for others.

7. Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by SecureBuildIQ and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. All rights not expressly granted are reserved.

8. Third-party services

The Service integrates with third parties (e.g., Supabase, Netlify, Anthropic, Stripe, Apple, and optional connectors like Smartsheet). Your use of those services may be subject to their terms. We are not responsible for third-party services.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, SecureBuildIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold SecureBuildIQ harmless from claims, losses, and expenses arising from your Customer Data, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Upon termination, your right to use the Service ends; we may delete Customer Data after a reasonable period unless the law requires otherwise.

13. Governing law & disputes

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Arizona for any dispute not subject to informal resolution.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new effective date; continued use after changes means you accept them.
